Trademark Service

A trademark search is an important first step before spending time and money in consideration of whether to apply for a potential trademark or not.

We conduct a trademark search in order to determine whether a mark is available for use and registration in Korea with respect to the related business sector. A full trademark search report will be provided, including comments on distinctiveness for the mark and any possible conflict with prior-registered or prior-filed trademark.

Search Fees

Our standard service fee for carrying out an initial class search for the word mark is USD 150 and the figurative mark is USD 200, and then USD 100 for each additional class.

Duration

Once we receive the payments, we will provide a full search report within four to five business days.

Trademark Renewal Service

The duration of the protection of a trademark right is 10 years from the date of registration of the trademark, which may be renewed every 10 years.

For the renewal of a trademark registration, an application for the renewal should be filed with KIPO. Once a renewal application has been duly filed, the trademark registration is deemed to have been renewed on the expiration date of the original registration.

Renewal Fee

Filing Fees for one class renewal application are USD 460 (legal fee of USD 200 and official fees of USD 260).

Our Filing Procedures

• Once we receive the information above (Full Registrant Name, Registration Number), we will prepare a Power of Attorney form for signature.
• We will send you an Invoice.
• We will confirm the registered trademark to be renewed with you.
• Once we receive the signed Power of Attorney form and the payment, we will proceed with the Renewal Application within 1-2 business days.
• After filing, we will send you a Renewal Filing Report.

Renewal Filing Request

Transfer of a trademark right or application

Generally, a trademark right may be freely sold or donated without reference to business, and divided by each of its designated goods.

Since the trademark rights are intangible property rights, they need to be freely transferrable like common property rights. The transfer of a trademark right or application replaces only the trademark owner, keeping the content of the trademark right or application intact.

Fee and duration

Filing Fees for assignment application are USD 292 only (legal fees of USD 165 and official fees of USD 127).

Once we file an assignment application with KIPO, it normally takes from three to four days to complete an assignment procedure.

What is needed for transfer of a trademark right or application?

To assign a trademark, you will need to submit the following documents.

• Contract of the assignment
• Executed power of attorney
• Notarized certificate of nationality
